Labour Law in 2026 — Overview of Changes
2026 continues the trend of labour law modernization in Poland. This year's amendments focus on employee protection, documentation requirements, and HR process digitization.
Remote Work — New Requirements
Mandatory Policy Review
Employers who implemented remote work policies in 2023 must review and update them by June 30, 2026, covering cost reimbursement, OHS assessments, and data protection rules.
Occasional Remote Work
The 24-day annual limit remains, but days must now be recorded in the HR system — employee declarations alone are no longer sufficient.
Employee Documentation — Digitization
Electronic Personnel Files
From January 1, 2026, employers with 50+ employees must maintain electronic personnel files. Documents must be stored in PDF/A or XML format with qualified signatures or electronic seals.
Electronic HR Workflows
Leave requests and HR documents can be submitted and signed electronically — a qualified signature is not required.
Minimum Wage
From January 1, 2026:
- Minimum salary — PLN 4,666 gross (up from 4,300)
- Minimum hourly rate — PLN 30.50 gross (up from 28.10)
Flexible Working Hours
Employees now have the right to request flexible working arrangements. Employers can refuse but must justify in writing within 7 days. This right applies to all employees, not just parents of young children.
What Should Employers Do?
- Update remote work policies by June 30, 2026
- Implement electronic personnel files if 50+ employees
- Verify all salaries meet the new minimum
- Prepare procedures for flexible working requests
- Update HR systems for occasional remote work tracking
